Welcome to Learn Enough, the website and mobile service of Softcover, Inc. (“Softcover,” “Learn Enough,” “softcover.io,” “learnenough.com,” “we,” or “us”). This page explains the terms by which you may use our online and/or mobile services, website, and software provided on or in connection with the service (collectively the “Service”). By accessing or using the Service, you signify that you have read, understood, and agree to be bound by this Terms of Service Agreement (“Agreement”) and to the collection and use of your information as set forth in the Learn Enough Privacy Policy , whether or not you are a registered user of our Service. This Agreement applies to all visitors, users, and others who access the Service (“Users”).

PLEASE READ THIS AGREEMENT CAREFULLY TO ENSURE THAT YOU UNDERSTAND EACH PROVISION. THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION OF DISPUTES PROVISION THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.

Use of Our Service

Learn Enough provides an online interactive platform for taking coding classes.

Eligibility

This is a contract between you and Learn Enough. You must read and agree to these terms before using the Learn Enough Service. If you do not agree, you may not use the Service. If you are a child under 13 years of age, we may need your parent or guardian’s consent before allowing you to use the Service. Supplemental terms and conditions may apply to some Services, such as rules for a particular competition, promotion, service or other activity, or terms that may accompany certain content accessible through the Services. Supplemental terms and conditions will be disclosed to you in connection with such competition, service or activity. Any supplemental terms and conditions are in addition to these terms and, in the event of a conflict, prevail over these terms. The Service is not available to any Users previously removed from the Service by Learn Enough.

Learn Enough Service

Subject to the terms and conditions of this Agreement, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Service for your personal, noncommercial use only and as permitted by the features of the Service. Learn Enough reserves all rights not expressly granted herein in the Service and the Learn Enough Content (as defined below). Learn Enough may terminate this license at any time for any reason or no reason.

Learn Enough Accounts

Your Learn Enough account gives you access to the services and functionality that we may establish and maintain from time to time and in our sole discretion. By connecting to Learn Enough with a third-party service (for example, Facebook or Twitter), you give us permission to access and use your information from that service as permitted by that service, and to store your log-in credentials for that service.

You may never use another User’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. You must notify Learn Enough immediately of any breach of security or unauthorized use of your account. Learn Enough will not be liable for any losses caused by any unauthorized use of your account.

You may control your User profile and how you interact with the Service by changing the settings in your “account settings” page. By providing Learn Enough your email address you consent to our using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. We may also use your email address to send you other messages, such as changes to features of the Service and special offers. If you do not want to receive such email messages, you may opt out or change your preferences in your “account settings” page. Opting out may prevent you from receiving email messages regarding updates, improvements, or offers.

School Accounts

If you are a School seeking to utilize the Service for educational purposes, you may create accounts for your Students via our Pupil Dashboard. Once the accounts have been created, Teacher will be able to view the progress and completion statistics of students via the Pupil Dashboard. By submitting Student information to Learn Enough, you expressly grant, and you represent and warrant that you have all rights necessary to grant, to Learn Enough a non-exclusive, royalty-free, worldwide license during the term of the Agreement to use, transmit, distribute, modify, reproduce, display, create derivative works of, and store the Student data solely for the purposes of (i) providing the Services as contemplated in these Terms, and (ii) enforcing its rights under the Agreement.

The Children’s Online Privacy and Protection Act (“COPPA”) requires that online service providers obtain clear and verifiable parental consent before receiving personal information from children under 13. Because Learn Enough provides the Service to School to benefit and enhance the School’s curriculum, Learn Enough RELIES ON SCHOOL TO OBTAIN AND PROVIDE APPROPRIATE CONSENT, IF NEEDED, TO COLLECT STUDENT INFORMATION. School represents and warrants that School has the authority to provide consent for Learn Enough to collect information from students before allowing students under 13 to access our Service, and that School has provided appropriate disclosures to students and parents regarding School’s sharing of Student Data with service providers such as Learn Enough. We recommend that School provide a copy of our Privacy Policy to parents and guardians.

We may, without prior notice, change the Service; stop providing the Service or features of the Service, to you or to users generally; or create usage limits for the Service. We may permanently or temporarily terminate or suspend your access to the Service without notice and liability for any reason, including if in our sole determination you violate any provision of this Agreement, or for no reason. Upon termination for any reason or no reason, you continue to be bound by this Agreement.

You agree that any User Content that you post does not and will not violate third-party rights of any kind, including without limitation any Intellectual Property Rights (as defined below) or rights of privacy. Learn Enough reserves the right, but is not obligated, to reject and/or remove any User Content that Learn Enough believes, in its sole discretion, violates these provisions. You understand that publishing your User Content on the Service is not a substitute for registering it with the U.S. Copyright Office, the Writer’s Guild of America, or any other rights organization.

Learn Enough takes no responsibility and assumes no liability for any User Content that you or any other User or third party posts or sends over the Service. You shall be solely responsible for your User Content and the consequences of posting or publishing it, and you agree that we are only acting as a passive conduit for your online distribution and publication of your User Content. This Agreement shall be governed by the internal substantive laws of the State of California, without respect to its conflict of laws principles. The parties acknowledge that this Agreement evidences a transaction involving interstate commerce. Notwithstanding the preceding sentences with respect to the substantive law, any arbitration conducted pursuant to the terms of this Agreement shall be governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16). The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Learn Enough is not responsible for any automatic filtering you or your network provider may apply to email notifications we send to the email address you provide us. Learn Enough may, in its sole discretion, modify or update this Agreement from time to time, and so you should review this page periodically. Your continued use of the Service after any such change constitutes your acceptance of the new Terms of Service. If you do not agree to any of these terms or any future Terms of Service, do not use or access (or continue to access) the Service.

Entire Agreement/Severability. This Agreement, together with any amendments and any additional agreements you may enter into with Learn Enough in connection with the Service, shall constitute the entire agreement between you and Learn Enough concerning the Service. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect, except that in the event of unenforceability of the universal Class Action/Jury Trial Waiver, the entire arbitration agreement shall be unenforceable.

No Waiver. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and Learn Enough’s failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision. Government Use Rights. If the Service is licensed to the United States government or any agency thereof, then the Service will be deemed to be “commercial computer software” and “commercial computer software documentation,” respectively, pursuant to DFAR Section 227.7202 and FAR Section 12.212, as applicable. Privacy Policy effective date: October 14, 2014

This privacy policy has been compiled to better serve those who are concerned with how their personally identifiable information is being used by Softcover. This, as used in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your information

When purchasing or registering on our site, as appropriate, you may be asked to enter your name, email address or other details to help you with your experience.

We will never sell your private data or information. We don't give out your private info to organizations that may sell it. We do though disclose some customer information to SAAS providers that we use in order to make the Softcover service functional. Those third party companies include Google Mail for any communication with us, Circle CI for continuous integration testing, Heroku for hosting, Amazon S3 for storage—each of these has their own privacy policies.

Your Content

Softcover accesses your code through the open-source Softcover gem only if and when you decide to use the Softcover site to manage sales. Your content is never delivered to Softcover if you build your content but do not publish the files to Softcover. The Softcover service operates on a read only basis and does not write any information into your content, as the gem is open source you can see exactly what it does—once it is sent to Softcover we keep only your rendered files.

No human ever reads your code in the normal order of business operations, and we only have access to your code with your express permission and through your installing and configuring the Softcover gem.

Security

All access to account information, payment information, and author sales data is conducted over SSL connection, and all passwords are 1-way encrypted, never plaintext. Softcover admins will never access your sensitive data unless you specifically authorize us to do so, and Softcover admins have no access to your password.

Transactions are processed through Stripe.com, a 3rd party payment processor, and all payment information is stored on Stripe. For authors, your sales revenue never passes through Softcover and is always stored only in your personal Stripe account. Royalties for use of the sales platform are taken out during the transaction so funds are never co-mingled. We cannot access any sales information stored on Stripe without your supplying us with a valid API key.

Cookies

We use cookies to help us remember and process the items in your shopping cart, to help us understand your preferences based on previous or current site activity (which enables us to provide you with better services), and we also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future.

We may also use trusted third party services that analyze this information on our behalf to better understand our customers.

If you disable cookies in your browser, some features will be disabled.

Partners

Softcover is built on Amazon EC2 and Amazon S3 through Heroku. If the EC2 service becomes vulnerable, your content may also become vulnerable to accidental disclosure. Amazon's Security Center discusses their security in great detail.

CalOPPA

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law's reach stretches well beyond California to require a person or company in the United States (and conceivably the world) that operates websites collecting personally identifiable information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals with whom it is being shared, and to comply with this policy.

According to CalOPPA, users can visit our site anonymously, and this privacy policy is always available in the footer of the website. Our Privacy Policy link includes the word 'Privacy', and can be easily be found on the page specified above, and users will be notified of any privacy policy changes on the Privacy Policy page.

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under 13, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation's consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online. We do not specifically market to children under 13.

Fair Information Practices

In order to be in line with Fair Information Practices, should a data breach occur we will notify the users via email within 7 business days.

Feedback

We take security incredibly seriously. If you have any suggestions for how we could improve our security, or improve this policy, please contact us at info@softcover.io. We will act immediately to deal with the issue.
